Platform Terms of Service

These Terms govern access to the GoPBIS platform. “School” means the school, district, or organization that obtains access. “User” means an authorized administrator, staff member, student, or other account holder. By using GoPBIS, you agree to these Terms and any applicable order form or written agreement.
Eligibility and school authorization
A person accepting these Terms for a school represents that they have authority to do so. Student accounts must be created or authorized by a participating school. A school is responsible for deciding who may use its account, assigning appropriate permissions, and meeting its own obligations for educational records and notices.
Accounts
Users must provide accurate account information, protect credentials, and promptly report suspected unauthorized access. Accounts are personal unless GoPBIS provides a designated shared or kiosk workflow. The school is responsible for keeping its user roster and permissions current.
Acceptable use
Users may use GoPBIS only for lawful school operations and educational purposes. Users may not:
- Access another person’s account or records without authorization.
- Upload unlawful, harmful, deceptive, or infringing content.
- Probe, disrupt, overload, reverse engineer, or bypass platform security or access controls, except where law expressly permits.
- Use platform data to advertise to students, discriminate unlawfully, harass, or cause harm.
- Copy, resell, or provide the service to an unauthorized third party.
School data
The school retains its rights in the records it submits. The school grants GoPBIS the limited right to host, process, back up, transmit, and display that data as needed to provide, secure, and support the service. The school represents that it has authority to provide the data and instructions it gives us. GoPBIS does not claim ownership of school educational records.
Privacy
Our Platform Privacy Policy and COPPA Notice describe our data practices. If a separate data privacy agreement applies, that agreement controls where it conflicts with these general Terms.
Service and changes
We work to keep GoPBIS available and reliable, but maintenance, security events, third-party failures, and circumstances outside reasonable control may interrupt service. We may improve, add, replace, or discontinue features. We will make reasonable efforts to communicate material changes that substantially affect a subscribing school.
Fees, suspension, and termination
Paid access is governed by the applicable order and the Billing and Payment Policy. We may restrict or suspend access for material nonpayment, security risk, unlawful activity, or a material breach, using notice and an opportunity to resolve the issue when circumstances reasonably allow. Either party may end service as provided in the applicable order or written agreement.
Ownership and feedback
GoPBIS and its licensors own the platform, branding, software, and documentation, excluding school data. If you voluntarily provide suggestions, GoPBIS may use them without restriction or payment, while avoiding disclosure of identifiable student records.
Disclaimers and responsibility
GoPBIS supports school workflows; it does not replace professional judgment, school policy, emergency procedures, or legal advice. To the extent permitted by law, the service is provided without warranties not expressly stated in a signed agreement. Neither party is responsible for indirect, special, incidental, or consequential damages to the extent the law permits. Any additional limitations or remedies in a signed order or agreement control.
General terms
Applicable law and any signed agreement govern disputes. If part of these Terms is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. The school may not transfer its subscription without written approval, except as part of a permitted organizational reorganization or as otherwise agreed.
